User Agreement (EULA) for an Augmented Reality social network application

1. Introduction
Welcome to HERE!
This User Agreement (hereinafter referred to as the "Agreement") sets out the terms of use of the application HERE. By using the Application, you agree to the terms of this Agreement. If you do not agree to the terms of this Agreement, do not use the Application.

2. Definition of terms
Application: HERE
Developer: Areliti LLC OR (Ivan Andreevich Maltsev) the owner and developer of the Application.
User: Any person who uses the App.
Content: Any information that a User posts or uploads to the App, including text messages, images, videos, sounds, 3D models, and location data.
AR content: Virtual objects, characters, effects and interactions created by the Application using augmented reality

3. Using the app

• Access: The User can access the Application through website, mobile application.
• License: The Developer grants the User a non-exclusive, non-transferable license to use the Application in accordance with the terms of this Agreement.
• Restrictions: The user does not have the right:
• Modify, decompile, disassemble, or decrypt the Application.
• Sell, lease or transfer the rights to use the Application to others.
• Create derivative works based on the Application

4. User Content
Responsibility: The User is solely responsible for all the Content that he posts in the Application.
Rights: The User grants the Developer a non-exclusive, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works, distribute and demonstrate Content in any formats and on any platforms.

• Content Removal: The Developer has the right to remove any Content that violates the terms of this Agreement without notice.
• Unwanted content: The User has no right to post the following Content in the Application:
• Illegal, threatening, insulting, defamatory, pornographic, racist, sexist, discriminatory or obscene.
• Violating the intellectual property rights of third parties.
• Containing viruses, worms or other malicious programs.
• Containing spam, fraud, or unsolicited commercial messages.
• Violating the privacy or privacy of third parties.
• Containing location information that may disclose personal information about the User or third parties.
• Violating the rules of the Application regarding the use of augmented reality (for example, posting AR content that may be dangerous or harmful).
• Violation Report: The User can report a violation of the terms of this Agreement by contacting the Developer via email info@he-ar.app.

5. Augmented Reality (AR)

• Responsibility: The User is responsible for using AR content in the Application in a safe and responsible manner.
• Security: The user must use AR content in a way that does not endanger himself or other people, does not violate privacy and does not interfere with public order.
• Access to information: The user must be aware that AR content may collect data about their location and environment.
• Posting AR content: The user should avoid posting AR content that:
• It can be dangerous, for example, to create obstacles on the roads, interfere with pedestrians, or create a feeling of anxiety.
• Violates privacy, for example, the placement of AR content that is displayed in private rooms or on personal items.
• It interferes with public order, for example, by posting AR content that causes panic or anxiety.

6. Responsibility

• Limitation of liability: The Developer is not responsible for any losses incurred in connection with the use of the Application, including, but not limited to, losses related to loss of data, profits, use opportunities or other material losses.
• Warranties: The Application is provided "as is", without warranties of any kind, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose and non-infringement.
• Legality: The User is responsible for compliance with all applicable laws and regulations when using the Application

7. Changes
The Developer has the right to make changes to this Agreement at any time. The changes take effect from the moment they are published in the Application. The User is obliged to review this Agreement regularly.

8. Termination
The Developer has the right to terminate this Agreement at any time without prior notice. The User may terminate this Agreement at any time by deleting the Application.

9. Applicable law
This Agreement is governed by and construed in accordance with the laws of Armenia.

10. Arbitration
Any disputes arising in connection with this Agreement shall be resolved by arbitration in accordance with the rules of the Arbitration Institution at the Chamber of Commerce and Industry of Armenia.

12. Consent
By clicking the "Accept" button, you confirm that you have read and understood this Agreement and agree to its terms.
